IAM Round Table – “Taken for granted” – with Ch. W. Appelt and Dr. M. Engelhard

The trade magazine IAM organised a Round Table on the subject of “Patent prosecution” in which BOEHMERT & BOEHMERT patent attorneys Christian W. Appelt and Dr. Markus Engelhard as well as colleagues from other law firms participated. 

In this round table, the invited IP specialists discussed current innovations and changes in their clients’ requirements for obtaining intellectual property rights worldwide, securing their rights management and portfolio quality through their consulting services tailored to the respective case. New technologies, for example in the field of artificial intelligence or medical diagnosis, require adapted patent strategies. Ch. W. Appelt and Dr. M. Engelhard agree on this: “Patents are the currency of the 21st century when it comes to technology and knowledge-based societies. Being part of the process of manufacturing this currency is extremely exciting and rewarding.”

BOEHMERT & BOEHMERT supports Open Source Monitor 2019

In the press release of 16 September 2019, Bitkom announces the first results of the Open Source Monitor 2019 project, which was realised on behalf of the Digitalverband and with the support of renowned companies. BOEHMERT & BOEHMERT is pleased it was able to support this first comprehensive Open Source study in Germany. For the survey, 840 companies with more than 100 employees in Germany were interviewed by telephone. Two thirds of the larger companies already consciously use Open Source software and only 4 percent view the topic critically or reject the use. Already 9 of 10 larger firms recognise advantages through Open Source, but many also see the difficulties that arise with the use of Open Source software, especially as regards compliance processes. We will publish our findings from this study shortly.

In the “Journal of Intellectual Property Law & Practice” (jpz109, 04.09.2019) the article “The myth of the ‘small patent for the small inventor’-strategic motives to use second-tier patent systems (utility models) in selected European countries” was published. The authors are all specialists in the field of utility model law, including patent attorney Prof. Dr. Heinz Goddar and attorney Dr. Carl-Richard Haarmann, both BOEHMERT & BOEHMERT.

In this article, the team of five authors explains the strategic use of utility models in the European context and possible adaptations: “There are at least six major parameters of first-tier patent systems that can be changed to create a UM-system. While this makes national UM systems highly heterogeneous, we found that changing certain parameters (like lowering the maximum term of protection compared to first-tier patents) may be in practice less problematic than changing others (like lowering the inventive step threshold).”

Dr. Florian Schwab discusses current brand case in WTR Daily

Writing in the online portal of the World Trademark Review, attorney Dr. Florian Schwab reports on the brand conflict of the eponymous motor vehicle manufacturer MAN regarding the Union trademark application MANDO. The European Court of Justice essentially held that there was no likelihood of confusion between the EU word mark MANDO and the higher ranking marks(Case T-698/17, 12 July 2019).
