Trade mark seminar on 15 November 2017 in Düsseldorf.

This year again, the trade mark seminar will look at current issues, such as “copyright protection for brands after the Federal Supreme Court “Birthday Train” decision on European design law.  – What companies must pay attention to. Dr. Rudolf Böckenholt, Attorney, Bremen, Dr. Carl-Richard Haarmann, Attorney, Munich and Düsseldorf, Martin Wirtz, Attorney, Düsseldorf and Berlin, and Dr. Anke Nordemann-Schiffel, Attorney, Berlin and Potsdam, will answer questions and are available for discussion.

The Annual trade mark seminar takes place in five locations throughout Germany.  The seminar will begin at 2p.m. and end at 5p.m. Participants are subsequently invited to snacks. Participation is free of charge.

On 15 November 2017, the 11th Göttingen Copyright Congress will take place, this year focusing on the current debate on copyright at the European and national level. Dr. Martin Schaefer will be among the speakers at the event; he will participate in the podium discussion on the current state of copyright law in Brussels and Berlin. The programme will be led by Prof Gerald Spindler and Prof Andreas Wiebe from the University of Göttingen.

“B&B-Bulletin”: Special Edition November 2017

The current special edition of the newsletter provides information on the “Countdown to the General Data Protection Regulation (GDPR), which will enter into force throughout Europe on 25 May 2018. The GDPR introduces new duties and provisions for data processing companies and brings with it considerably higher fines. The special edition provides information on the most relevant changes. The article “Patent Proceedings in the US – Patent Holders can no longer choose their Court” by solicitor Dr Michael Rüberg and patent attorney Dr Dennis Kretschmann has now appeared in the December edition of ICC Germany Magazine by the International Chamber of Commerce (page 48, 05/2017).

The background: The US Supreme Court has limited the free choice of jurisdiction regarding patent claims. Companies domiciled or with branch in the US can no longer choose the place of jurisdiction. In their article, the authors explain the impact on German and American companies. They draw the following conclusion: “The patent landscape in the US has been subject to significant change for years. This has meant that it has become much more difficult to obtain patents in the US, to defend them against infringements and to enforce against parties in breach. The decision is a reaction against the abuse of the US system by patent trolls. On the other hand, many of the measures also impair the efficient response to patent infringements from legitimate patent holders.”

The firm also managed to retain its very good rankings from previous years in the current edition of the JUVE Manual of Corporate Law Firms 2017/18. In total, 16 patent attorneys and lawyers were listed specially this year.

In the “Patent Law – Patent Registrations” category, the firm takes pole position. In “Patent Processes – Patent Lawyers”, the firm is placed in the second category of the named law firms. In “Patent Processes / Lawyers”, it ranks in 4th position this year too. JUVE states here: “In Patent Law, B&B is one of the leading law firms. B&B actively leads proceedings with its mixed team.” Prof Dr Heinz Goddar (Physics) and Dr Jan B. Krauß (Pharmaceuticals) were again given special mention as patent attorneys with recommended technical focus. The following patent attorneys were very often recommended: Prof Dr Heinz Goddar, Dr Jan B. Krauß, Christian Appelt, Dr Markus Engelhard, Dr Stefan Schohe and Dr Karl-Heinz Metten.

In the category “Trade Mark and Design Law“, the firm remains in 3rd place this year. “Rivals regularly attest B&B, which is recommended in trade mark and competition law, a large presence in proceedings,  in particular when compared to other mixed firms. On 9 and 10 November 2017, a conference will be held in Washington, D.C. by University College London in collaboration with George Washington University entitled “Patents in Telecoms and the Internet of Things”.  Professor Dr. Heinz Goddar will be moderating Panel IX on 10 November covering the topic “Patent Assertion Entities”.

16th International Trademark Conference in Alicante – with Prof J. B. Nordemann.

8. November 2017/in Events

From 8 to 9 November 2017, the 16th International Trademark Conference organised by the Forum Institute will take place in Alicante. The main topics this year will be EU trademark reform, Brexit and the impact on trademark holders as well as various other practice-related cases in trademark and design law. Attending the second day of the conference and the part “Recent questions from practitioners answered by the experts” will be Prof. Dr. Jan B. Nordemann who will answer key questions on “3D printing and trade marks”.

Meaningful Patent Protection in Life Sciences

Dr. Ute Kilger will be speaking on 21/11/2017 together with Dr. Klaus-Peter Döpfer (Director of Directorate 1412, Biotechnology, European Patent Office) as part of the SPARK Programme in Berlin on the extent of data required to ensure meaningful patent protection in life sciences. The need to validate inventions via data will be discussed in clear terms by means of case studies.

The SPARK programme, a worldwide network, was called into existence in 2006 by Stanford University (USA) and has been growing ever since. Its objective is to quickly establish new academic developments on the market. Further information

“Communication to the public” – ALAI Congress with speech by Prof J. B. Nordemann.

The International Copyright Association ALAI Germany will hold an event on 2 November 2017 focussing on “communication to the public”. The event will be held in Munich. The event will look at the criteria set down by the ECJ regarding the term “public” and sets out the impact of these criteria on German and Austrian jurisprudence. Prof. Dr. Jan B. Nordemann will speak on the issue of “GS Media, Filmaspeler and The Pirate Bay: A European liability concept for public?” Nordemann is attorney at law and certified attorney for copyright and media law and for industrial property rights in Berlin.
