Introduction
This seminar provides an update on specific aspects of the changing IP landscape in view of recent political developments and court decisions in the area of life science and chemical inventions.
It provides strategies for how to obtain useful protection in view of such changes:
An example of a changing IP landscape are develop-ments resulting from the introduction of the Unified Patent Court and the Unitary Patent system. These new instruments have changed filing, prosecution and enforcement strategies throughout Europe and conti-nue to shape the management of patent portfolios in both legal and commercial practice.
The UPC is increasingly producing case law on topics such as inventive step, infringement and procedural law, while the EPO continues to refine its approach in areas including second medical use claims. Recent decisions provide valuable guidance for applicants and patentees but also create new challenges that must be addressed during prosecution and enforcement. Although the UPC offers the possibility of centralized patent litigation across participating member states, national patents and national courts continue to provide important strategic advantages in many circumstances.
