Peter Gross has focused his activities on the development of trade mark strategies, and he is very experienced in the defense and enforcement of intellectual property rights within Germany and abroad.The owners of large trade mark portfolios as well as companies who are at the early stages of setting up their trade mark and IP rights find him to be a competent legal advisor.

Furthermore, he conducts infringement proceedings in patent, trade mark, competition and design law matters. He also has a great deal of experience in the field of sales and distribution of me-too products.

His clients value the fact that he not only focuses on the legal issues, but that he also focuses on developing a clear and practical approach with regard to how legal problems can be settled as quickly and as cost-effectively as possible. He never loses sight of the economic consequences of a proposed solution in infringement proceedings, so it is not uncommon that preference is given to a pragmatic approach instead of a lengthy judicial dispute.

After having completed his studies in law at the University of Regensburg, he spent one year at the University of Aberdeen, Scotland, on a postgraduate course as an ERASMUS scholar where he obtained his Masters of Law (LL.M.) degree. In addition, he worked as a research associate from 1998 to 2003 at the University of the German Federal Armed Forces, Munich, at the Institute for Comparative Business Law, Technology Law, and Procurement Law.

Peter Gross began his legal career in 2001 in a patent law firm where he built up and expanded the legal side of the practice. After being partner there for five years, he joined the Munich office of BOEHMERT & BOEHMERT.

He is co-author of the practice handbook “Intellectual Property in the Food Industry”. Peter Gross is recommended in the Managing Intellectual Property IP Stars Handbook 2015 and in “WTR 1000 – The World’s Leading Trademark Professionals 2019”. He is also repeatedly recognized as a “Best Lawyer” 2023 by the trade publisher Best Lawyers.

Andreas Lucke is involved with building and maintaining patent portfolios in the fields of optical networks, semiconductor technology, medical engineering, IT, and software patents. One focus of his work concerns patent applications for universities, German, and international research institutions. Andreas Lucke regularly conducts patent infringement, opposition and nullity proceedings, and coordinates international litigation.

He is often entrusted with conducting oral proceedings before the Opposition Divisions and Technical Boards of Appeal of the European Patent Office. Further, he counsels his clients regarding technology transfer, license agreements, and employee invention rights.

Andreas Lucke studied physics in Konstanz, Freiburg, and the University of Massachusetts, where he received his Master of Science. During his PhD, he did research on quantum coherence and electron transfer reactions at the Institute of Theoretical Condensed Matter Physics at the Freiburg University, and at the University of Southern California in Los Angeles.

After being trained in IP rights in a Munich-based patent firm, he was admitted as a German patent attorney in 2005, and as a European patent attorney in 2006.

In 2006, Andreas Lucke joined BOEHMERT & BOEHMERT.

In addition to his work as a patent attorney, he is involved in teaching and training patent attorneys, and has been a tutor at the Robert-Schuman-University in Strasburg (CEIPI) since 2007, where he prepares candidates for the European patent attorney qualification exam. Since summer 2016, he lectures on intellectual property rights at the University of Applied Science Munich.

Markus Engelhard is active in all fields of life sciences, pharmacology, and biotechnology, having a particular focus on therapeutic biomolecules and pharmaceutically active agents. His clients include start-up companies, small and medium-sized enterprises, multinational corporations, universities, and academic research institutions. He supports them in acquiring and enforcing intellectual property rights, building up patent portfolios, and representing them in opposition, invalidation, and infringement proceedings. Moreover, he provides professional advice to international organizations, government agencies, and technology transfer agencies.

Markus Engelhard was a scholar of the Studienstiftung des deutschen Volkes and studied biology, chemistry, and biochemistry at the University of Cambridge, UK, the University of Frankfurt am Main, and the University of Witten-Herdecke. After graduation, he obtained his PhD with an Oliver Gatty Studentship from the Department of Biochemistry of the University of Cambridge, where he was a postdoctoral fellow in research and teaching.

Since 1998, Markus Engelhard is with BOEHMERT & BOEHMERT. As part of his professional activities, he has lectured on behalf of the World Intellectual Property Organization (WIPO) in its “Regional Capacity Building Workshops on Patent Drafting” for developing countries and has trained patent agents from nearly 30 countries.

He also lectures regularly on patent law issues both in Germany and abroad, with much of his work focusing on Asia. The National Law University Delhi (NLUD), India, appointed him as visiting faculty at the beginning of 2014. He is an Honorary International Chair Professor at the National Taipei University of Technology, Taiwan since 2014. Best Lawyers 2018 names him as one of eleven selected BOEHMERT & BOEHMERT attorneys. The JUVE Handbuch 2019/2020 lists him as a highly recommended attorney.

Christian W. Appelt is focused on personal counseling of SMEs in Germany and Europe in all aspects of Intellectual Property, especially Patents and Utility Models, and on representing and advising large, internationally active companies, especially from Japan, China, and the US. His technical concentration is on physics, mechanical engineering, electronics, and computer technology (ICT). Besides drafting and prosecuting patent applications, Christian W. Since 2004, he is an assistant professor at the University of Applied Sciences, Kiel, Germany. Christoph Angerhausen focuses on the registration, maintenance, protection and challenge of patents and industrial designs as well as on the development of national and global protection strategies and the establishment and maintenance of patent portfolios in various fields of engineering and physics. Martin Schaefer works primarily in the field of intellectual property, including copyright contract law. “Company invention – and now?” New article by Prof. Dr. Goddar in the trade magazine Arbeitsrecht im Betrieb

It is not uncommon for employees to develop ideas or innovations in the course of their work which increase the efficiency of operational procedures or improve products manufactured in the company. Such inventions in the workplace must be reported to the employer. 

But what does a proper invention disclosure to the employer look like? What requirements should an employee invention fulfil in order to be filed for a patent? And what remuneration is appropriate for an employee invention?
