Mixed law firm BOEHMERT & BOEHMERT is taking on two new partners, Sebastian Engels and Silke Freund, as we go into the new year. Both attorneys specialize in the fields of copyright, media law and trademark law, and as partners they will support the patent and legal teams at the firm’s Berlin and Munich branches.

BOEHMERT & BOEHMERT has performed extremely well in the Kanzleimonitor 2019/2020 survey, for both industrial property protection and patent law. The law firm is also ranked among the top ten in the media field. BOEHMERT & BOEHMERT continues to hold first place for patent law, receiving the most recommendations of all law firms included in the survey; the company is also ranked second overall in the area of industrial property protection. Attorney at Law Dr Carl-Richard Haarmann is one of the most frequently mentioned attorneys in the field of industrial property protection, along with Dr Martin Schaefer.

The “kanzleimonitor.de – Empfehlung ist die beste Referenz” (kanzleimonitor.de – Recommendations are the best reference”) survey of experiences is published annually by the German Institute for Legal Departments and Corporate Lawyers (Deutsches Institut für Rechtsabteilungen und Unternehmensjuristen GmbH). The 2019 Kanzleimonitor survey was based on feedback from a total of 821 companies and over 5,000 corporate lawyers from companies in all fields and of varying sizes across Germany.

Berlin/Munich, 13.12.2019 – Mixed law firm BOEHMERT & BOEHMERT is taking on two new partners as we head into the new year: Sebastian Engels and Silke Freund. Both lawyers specialise in the fields of copyright, media law and trademark law, and as partners they will strengthen the patent and legal teams at the firm’s Berlin and Munich offices.

Dr Sebastian Engels advises clients on all strategic matters pertaining to trademark, copyright and competition law. He focuses in particular on offering comprehensive legal advice and representation to e-commerce and IT providers, and additionally specialises in the area of domain law. He also assists in pursuing and defending cases involving violations of intellectual property and competition law.

Based at the Berlin offices of BOEHMERT & BOEHMERT, Engels will join Dr Andreas Dustmann and Dr Martin Schaefer as a new partner on the legal team, and Dr Ute Kilger and Dr Thomas Bittner on the patent attorney team. Sebastian Engels has been working at the Berlin offices of BOEHMERT & BOEHMERT since passing the bar in 2011.

Silke Freund also has extensive experience in the fields of trademark law, copyright, general personal rights and freedom of expression. In her work, she focuses mainly on the enforcement and defence of trademarks. Ms Freund also assists her clients with global trademark portfolio management and advises them on the legality of marketing and advertising campaigns. Other focal points include defence of copyright, intellectual property rights and rights of use. She also works regularly in the area of freedom of expression, as well as print and visual reporting with regard to general personal rights considerations.

The Attorney at Law will be appointed as a new partner at the Munich offices of BOEHMERT & BOEHMERT. Silke Freund has worked with a number of prominent partner firms and major international law firms since 2002, focusing on media, copyright and trademark law. She moved to BOEHMERT & BOEHMERT in 2013.

Post-election Brexit update on trade marks and designs

1. What is the current situation?

Brexit is approaching but the Agreement remains to be ratified and transformed into UK laws.

On October 28, 2019 another extension has been agreed until January 31, 2020 the latest. Until then, the UK remains full member of the EU with all rights and obligations. There are no immediate changes for right owners at this time.

It was not possible to finalize the political compromise reached on October 17, 2019 between EU and UK towards a final positive vote in UK Parliament. The extension also related to the General Election which was now held in the UK on December 12 2019. On substance, we will thus likely see furhter progress only after the election and assenbmbly of the Parliament probably by early January 2020.

2. What are the consequences of Brexit for trade marks and designs?

With Brexit, all European Union trademarks and Community Designs will cease to have effect in the UK. This will likewise apply to the equivalents under International Registrations.

Mechanisms and comprehensive statutory framework have been set up to reduce negative effects for right owners.

a) European Union Trademarks

All registrations not finally expired will be cloned on the UK register, by automatic data transfer from EUIPO, without examination, free of charge and fully identical to the EU right.

Pending applications will cause a 9 months` period to re-file in the UK register. Such applications will be identical to the EU right but will be examined by the UK Office and cause standard fees.

b) Registered Community Designs

All registrations not finally expired will be cloned. Pending applications cause the same 9 months` period to re-file. Applications with deferred publication will be granted a deferred publication in the UK register for 12 months from re-filing.

Unregistered Community Desings will continue as Continuing Unregistered Design in the UK for the remaining period of protection. There will be an additional Supplementary Unregistered Design but it is limited to the UK in territorial scope.

c) International Registrations

Trademarks and Designs designating the EU will be cloned or cause a right to re-file, both, however, only as a national UK rights. By incurring further costs and accepting another examination process, it is possible to replace this national right and reintegrate it into the International Register by subsequent designation.

3. Is there immediate need for action?

No. The solutions found shall apply with or without Agreement. But: Clones and Re-filings can double the portfolio when the EU level of protection shall be maintained.

It is thus sensible to review the portfolio soon and decide at an early stage which parts of the portfolio are useful or required for the UK. We will send a full report about relevant IP rights as represented by us.

Redundant rights can be abandoned (opt-out), re-filings can be provisionally instructed (opt-in) and relevant priority and renewal deadlines are addressed separately.

No new local representative will be needed. We will be entitled to represent the clones and re-filings at the UK Register which we currently represent at EU level. It is the goal of the United Kingdom to cause no further disruption to right owners in this regard. We are accepted as address for service and will be able to competently represent interests in a number of proceedings.

4. How about further information?

IP-related contracts, exhaustion and channels of distribution, and other less pressing issues will be subject of further newsletters.

The issue “Focus Special Top Lawyers / Corporate Law Firms in Germany” (3/2019) ranks BOEHMERT & BOEHMERT 2019 among the top law firms in Germany in the areas of “Patent Law” and “Trademark Law”. This annual list names leading lawyers and law firms in a total of 21 specialist legal fields. The list, compiled by the news magazine, respectively the statistics company Statista, is based on colleague and client recommendations, for which over 10,000 lawyers in corporate law firms and around 3,500 experts in companies were surveyed. The firms included on the list have made a special name for themselves in their respective specialist fields.
