BOEHMERT & BOEHMERT attorneys elected to decisive positions in the most important associations of European and German patent attorneys

From this year onwards, two BOEHMERT & BOEHMERT patent attorneys and partners will attend important functions in national and European committees.
Dr. Michael Hartig was elected to the Council of the “Institute of Professional Representatives before the European Patent Office” (epi) and thus to the professional association of all European patent attorneys.
This Counsel is appointed by the members of the epi, who in turn elect the epi Board of Directors and members of various committees. As an organisation, the epi is concerned with the development and effects of patent law, advises political decision-makers and is an observer in many advisory bodies of international organisations.

Dr. Michael Hartig works in various fields of intellectual property, but mainly in patent prosecution. This includes preparing patent applications, conducting all filing and examination proceedings at the patent offices for German and foreign clients, and the creating and managing of corresponding patent portfolios. His technical field of practice includes electronics, semiconductor physics, laser technology, medical technology, software, and universal physical applications. Since 2003, he has been a registered German as well as European patent attorney and a partner at BOEHMERT & BOEHMERT in Munich.

Dr. Ute Kilger was elected to another important committee. Since beginning of the year, the patent attorney with a doctorate in chemistry has been a member of the board of directors of the German Patent Attorney Association (Deutsche Patentanwaltskammer DPAK), which acts as the representative of all patent attorneys in Germany. As a public law corporation, the DPAK monitors i. a. compliance with professional law, assists in the training and admission to the German Patent Attorneyship as well as in national and international legislative projects.

Since August 2009, Dr. Ute Kilger has been working as a partner at BOEHMERT & BOEHMERT in Berlin. She assists pharmaceutical and biotechnology companies as well as academic institutes in all kinds of patent related issues concerning the obtaining and enforcement of property rights, due diligence, mergers & acquisitions, contract negotiations, and licensing agreements. In addition, Dr. Ute Kilger manages large patent portfolios, is involved in patent infringement processes where she represents her clients in nullity suits up to the German Federal Supreme Court of Justice.

First open source research in Germany and BOEHMERT & BOEHMERT is part of it

Without open source software we would not have smartphones, the Internet would not work and our working environment would be much different. And while freeware, as well as open source software, and the associated movement were largely rejected by the business community in earlier years, open source is now deliberately used in almost all larger companies.

This is the result of the first representative open source research in Germany by the digital association Bitkom and Bitkom Resaerch GmbH. BOEHMERT & BOEHMERT as well as eight other well-known companies were involved in the study as supporters.

According to this Open Source Monitor, two thirds of the companies surveyed deliberately use open source software. 31 per cent even participate in its further development. The high level of acceptance is evident in all sectors, with the retail trade and the automobile industry being particularly open-minded. In contrast, only 21 percent of the companies surveyed also have an open source strategy.

This positive attitude is based on the advantages that 88 percent of the companies see in the use of open source software. The most important reason cited is the saving of costs by eliminating license fees (17 percent). High security through timely updates, independence, a wide selection of open source components, as well as access to the source code and simple individual adaptations are further impulses for the use of open source software.

In the course of the research, 804 companies with at least 100 employees in Germany were surveyed, selected according to size classes and industries. For a uniform understanding, the definition of the term “open source software” was established at the beginning of each interview.

Fake e-mails in circulation!

Currently, numerous e-mails are sent whose signature blocks indicate that they are from BOEHMERT & BOEHMERT attorneys. Attention, these e-mails are fake! Authorised e-mails are only sent from addresses under @boehmert.de. The contained links are defective! The law enforcement authorities are investigating.

Brexit is there – no changes yet!

On January 31, 2020, 11 p.m. GMT, the UK has left the European Union. However, with no changes for businesses and consumers as of now. The Withdrawal Agreement includes a transitional period until December 31, 2020 within which EU laws fully continue to apply in and towards the UK.

It is generally possible to jointly extent this transitional period. EU bodies and the UK will use the transitional period to conclude an agreement to regulate their future relations.

BOEHMERT & BOEHMERT goes from strength to strength with two new partners

Berlin/Munich, 13.12.2019 – Mixed law firm BOEHMERT & BOEHMERT is taking on two new partners as we head into the new year: Sebastian Engels and Silke Freund. Both lawyers specialise in the fields of copyright, media law and trademark law, and as partners they will strengthen the patent and legal teams at the firm’s Berlin and Munich offices.

Dr Sebastian Engels advises clients on all strategic matters pertaining to trademark, copyright and competition law. He focuses in particular on offering comprehensive legal advice and representation to e-commerce and IT providers, and additionally specialises in the area of domain law. He also assists in pursuing and defending cases involving violations of intellectual property and competition law.

Based at the Berlin offices of BOEHMERT & BOEHMERT, Engels will join Dr Andreas Dustmann and Dr Martin Schaefer as a new partner on the legal team, and Dr Ute Kilger and Dr Thomas Bittner on the patent attorney team. Sebastian Engels has been working at the Berlin offices of BOEHMERT & BOEHMERT since passing the bar in 2011.

Silke Freund also has extensive experience in the fields of trademark law, copyright, general personal rights and freedom of expression. In her work, she focuses mainly on the enforcement and defence of trademarks. Ms Freund also assists her clients with global trademark portfolio management and advises them on the legality of marketing and advertising campaigns. Other focal points include defence of copyright, intellectual property rights and rights of use. She also works regularly in the area of freedom of expression, as well as print and visual reporting with regard to general personal rights considerations.

The Attorney at Law will be appointed as a new partner at the Munich offices of BOEHMERT & BOEHMERT. Silke Freund has worked with a number of prominent partner firms and major international law firms since 2002, focusing on media, copyright and trademark law. She moved to BOEHMERT & BOEHMERT in 2013.

IAM Round Table – “Taken for granted” – with Ch. W. Appelt and Dr. M. Engelhard

The trade magazine IAM organised a Round Table on the subject of “Patent prosecution” in which BOEHMERT & BOEHMERT patent attorneys Christian W. Appelt and Dr. Markus Engelhard as well as colleagues from other law firms participated. 

In this round table, the invited IP specialists discussed current innovations and changes in their clients’ requirements for obtaining intellectual property rights worldwide, securing their rights management and portfolio quality through their consulting services tailored to the respective case. New technologies, for example in the field of artificial intelligence or medical diagnosis, require adapted patent strategies. Ch. W. Appelt and Dr. M. Engelhard agree on this: “Patents are the currency of the 21st century when it comes to technology and knowledge-based societies. Being part of the process of manufacturing this currency is extremely exciting and rewarding.”

BOEHMERT & BOEHMERT supports Open Source Monitor 2019

In the press release of 16 September 2019, Bitkom announces the first results of the Open Source Monitor 2019 project, which was realised on behalf of the Digitalverband and with the support of renowned companies. BOEHMERT & BOEHMERT is pleased it was able to support this first comprehensive Open Source study in Germany. For the survey, 840 companies with more than 100 employees in Germany were interviewed by telephone. Two thirds of the larger companies already consciously use Open Source software and only 4 percent view the topic critically or reject the use. Already 9 of 10 larger firms recognise advantages through Open Source, but many also see the difficulties that arise with the use of Open Source software, especially as regards compliance processes. We will publish our findings from this study shortly.
