4 Josef-Kohler Symposium on “Copyright in the Knowledge Economy” with Dr M. Schaefer

On 12 June 2017, the 4th Josef Kohler Symposium will take place in Berlin on the subject of “Copyright in the Knowledge Economy – A new Copyright Law for Teaching and Research?”. BOEHMERT & BOEHMERT lawyer Dr. Martin Schaefer will attend the event and take part in a podium discussion on the new Copyright Act. Other participants are: Dr. Jens-Peter Gaul, General Secretary of the University Rector Conference, Prof Christian Sprang, Head of the Legal Department at Börsenverein des Deutschen Buchhandels, MR Matthias Schmid, BMJV, Berlin (invited), Prof. em. Dr. Artur-Axel Wandtke, Humboldt University Berlin. Hosted by: Jun.-Prof Katharina de la Durantaye, Humboldt University Berlin. The draft for an “Act for the harmonisation of copyright law in line with the current requirements of the knowledge economy” poses numerous questions: What specific requirements are made by universities, research institutions and libraries of copyright law? Where are the limits when balancing the interests of copyright owners and publishers? What role can collection companies play? These questions will be discussed by experts from academia, industry and politics.

On 12 June 2017, the 8th “GRUR meets Brussels Workshop” will take place, this time under the heading “The Digital Single Market Copyright Directive Proposal and beyond: Towards a `toolbox´ for future European Copyright Law“. BOEHMERT & BOEHMERT lawyer and trade mark law expert Dr Florian Schwab has published the article “No protection for EXHAUST-GARD” in the online portal of the specialist magazine World Trademark Review on 2 June 2017.

The article discusses the recently delivered decision of the European Court of Justice from 27 April 2017 (T-622/15).  In its judgement, the Court rejects the possibility of protecting the mark EXHAUST-GARD for diesel emission fluid in class 01. As both courts at lower instances found, the Court held that it was of purely descriptive character. In particular, English speakers with necessary knowledge would immediately connect the word mark (which is comprise of the word “exhaust” and “g(u)ard”) with protection from dangerous emissions produced from combustion in diesel motors, in particular with the reduction of nitrous oxide content in these emissions. “The decision of the European Court of Justice is therefore less surprising than the vehement defence of the registration over three instances,” Dr Florian Schwab comments.
