These new instruments have changed filing, prosecution and enforcement strategies throughout Europe and conti-nue to shape the management of patent portfolios in both legal and commercial practice.<\/p>\n<p>The UPC is increasingly producing case law on topics such as inventive step, infringement and procedural law, while the EPO continues to refine its approach in areas including second medical use claims. Recent decisions provide valuable guidance for applicants and patentees but also create new challenges that must be addressed during prosecution and enforcement.
