It provides strategies how to obtain useful protection in view of such changes.<\/p>\n<p>An example of a changing IP landscape are developments in patenting antibodies after Amgen Inc. v. Sanofi, 598 U.S. 594 (2023). This US Supreme court decision did not only change the jurisprudence in the USA but \u201cinfected\u201d examination and enforcement for antibody patents in numerous countries which will likely encourage fast followers.<\/p>\n<p>The EU legislators are currently debating about new regulations for Supplemental Protection Certificates, Data Protection, Compulsory Licenses, many of them favoring generic entry, called the EU Pharma Package.<\/p>\n<p>The scope of generic chemical formulae (Markush-Formulae) is increasingly being challenged on more formal grounds. Appropriate countermeasures in view of recent case law are discussed.<\/p>\n<p>Health claims as well as Nutritional claims according to EU Regulation (EC) No. 1924\/2006 once obtained add significant value to a food product.
