Kluwer Copyright Blog: Prof Jan B. Nordemann and V. Kraetzig comment "trimmed to the fat".

On 3 November, BOEHMERT & BOEHMERT partner Prof. Dr. Jan Bernd Nordemann and his paralegal Viktoria Kraetzig made a new contribution to the blog of the specialist publisher Wolters Kluwer. The contribution is entitled "The German Bundesgerichtshof changes its concept of parody following CJEU Deckmyn v. Vrijheidsfonds/ Vandersteen" and explains the decision of the Federal Supreme Court from 28 July 2016 (I ZR 9/15) in the case “Auf fett getrimmt” (“trimmed to the fat”). Here, the BGH held that the publication of copyright-protected works is permissible - in a modified form – when its is parodied. In the decision, the Court stressed that the interests of the copyright owner had to be weighed against those of the user. The entire blog entry can be accessed here.
