IHK Halle – Expert Forum: Dr Dustmann explains copyright law for experts.

The Chamber of Trade and Industry Halle – Dessau will host an expert forum on 28 November 2013 for further training of all court appointed and sworn experts in the Halle – Dessau region. Here, BOEHMERT & BOEHMERT partner and copyright and media law specialist, Dr Andreas Dustmann will explain “copyright law and expert audits”. He will explain how far experts own copyright to their own reports and which third party copyright must be taken into account in compilation of the report. Issue 10/2013 of the “Mitteilungen der deutschen Patentanwälte” includes an article entitled “The requirement for “utility” in the USA following Mayo v. Prometheus – repercussions on the practice of patent applications” written by BOEHMERT & BOEHMERT partner Dr Jan B. Krauss. Seminar “EPI Media Law Special” with Prof J. B. Nordemann.

On 22 November 2013, the Erich Pommer Institut (EPI) will hold a seminar EPI Media Law Special for solicitors, specialist lawyers, corporate lawyers and interested experts. Current developments in practice and case law will be explained and discussed using selected example cases. BOEHMERT & BOEHMERT partner and copyright expert Prof Jan Bernd Nordemann, who is also Legal Director of the EPI, will provide the section entitled “GTC assessment and grants of right by the author”. The seminar will be held in Berlin-Mitte and counts as further training for specialist lawyers active in the field of media and copyright law.

The German Lawyers Academy will hold two supplementary seminars with copyright experts from BOEHMERT & BOEHMERT on 8 and 9 November 2013 in Hamburg. On 8 November, Prof Jan Bernd Nordemann will head the seminar “Copyright Practice”. On 9 November 2013, Dr Christian Czychowski and Prof Nordemann will head the seminar on “Current Developments in Copyright – Legislation and Case Law”. Both events will last one day and will this year take place in Hamburg. The seminars are aimed at lawyers, publishers, music and film production companies, radio and television, internet and software companies, companies operating in the advertising and design industry, associations and collecting companies. Writing in the online specialist newspaper World Trademark Review Daily on 30 October 2013, BOEHMERT & BOEHMERT partner and trademark expert Dr Florian Schwab reported on the recent decision by the European Court of Justice (ECJ) (C-597/12 P Isdin SA ./. HABM) from 17 October 2013.. The decision concerned a very rare case in which a trademark decision of the European Court was reversed. The case involved opposition proceedings against the word mark ZEBINIX, based on the earlier community mark ZEBEXIR for pharmaceuticals. Notable in the decision was the fact that the European Court found a risk of confusion contrary to the two first instance decisions. However, the ECJ didn’t have to decide on this point in the proceedings against the decision of the European Court. The reversal of the first instance decision was based solely on the formal aspect of insufficient regard for the risk of confusion for the individual goods covered by the community mark.
