On 23 May 2012, the Bavaria Area Group of the German Association of Industrial Property Rights and Copyright (GRUR) invites participants to a lecture on “Copyright: Increased Control of General Terms and Conditions”, given by BOEHMERT & BOEHMERT partner Prof Jan Bernd Nordemann. Control of such contracts, which are usually pre-formulated, has long managed to avoid the focus of the courts. This has now changed. Certain clauses will no longer stand up to judicial control. Prof Nordemann will demonstrate what type of clause must be adjusted in form agreements. The lecture will be held in the DPMAforum of the German Patent and Trademark Office and begins at 17:30.

In the online magazine World Trademark Review Daily from 19.04.2012, BOEHMERT & BOEHMERT partner and brand law expert Dr Florian Schwab reports on the recent decision of the European Court of Justice (General Court) in the BEATLE / BEATLES case. In the decision, the Court – different to the Opposition Division – upheld the opposition to various BEATLES brands in connection with the famous British pop group raised against a picture mark BEATLE used mainly for wheelchairs. The Court upheld exploitation of the known BEATLES brand. In so doing, the Court drew protection of reputation very widely so that goods which are not prima facie similar are also included. On 9 May 2012, the media club Der Märkische Presse- und Wirtschaftsclub (MPW) will hold a round of discussions on “Patents in the Digital Age: Between Innovation and Product Piracy.” Until a few years ago, the primary use of patents was to protect inventions. The digital world has meanwhile changed the effect of patents. Whether patents are still protected and how aspects such as market competition, expansion and product piracy change entrepreneurial activities will be addressed in the discussion.
